Representative Maloney, Take Back the Court Drive Urgency of Court Expansion Ahead of 2nd Amendment Hearing

SAN FRANCISCO, CA (November 2, 2021) — Last March, Take Back the Court re-released our guns study showing how the Supreme Court’s conservative majority plays a leading role in enabling gun violence by threatening reasonable and clearly constitutional gun safety reform. Now, this Wednesday’s hearing in NY State Rifle & Pistol Assoc. v. Bruen — the first major guns case before the Supreme Court in over a decade — is a reminder that this Court is determined to go even further and actually expand the 2nd Amendment.

“2020 marked the deadliest year for gun violence in the last 20 years. And how does the Supreme Court respond? By asking for a case to expand gun rights which enables increased violence,” said Representative Carolyn B. Maloney. “There are so many tireless advocates working across the country to end gun violence and keep people safe. These advocates need to know they have strong support as they face six Justices’ extreme and dangerous readings of the 2nd Amendment. That requires responding to Wednesday’s hearing with the urgency this crisis demands. We must pass The Judiciary Act of 2021 and expand the Court.”

“Make no mistake: John Roberts, Brett Kavanaugh, and the rest of the Court’s stolen conservative majority know exactly what they are doing taking up this case,” said Take Back the Court Executive Director Sarah Lipton-Lubet. “Last April, Kavanaugh made it clear he is eager to expand the Second Amendment and asked for a case to be sent his way. He is champing at the bit to expand the 2nd Amendment and make it easier to carry concealed, dangerous weapons. We’re incredibly grateful to Representative Maloney and the more than 40 cosponsors of The Judiciary Act who are working to protect our kids and our communities by expanding the Supreme Court.”

Take Back the Court’s March study shows that the intentions of this Court are clear: Every conservative member, in prior rulings, has previously opposed efforts to end gun violence and keep people safe. READ MORE.

Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
