We’ve been championing Court expansion from the start. Our founder, Aaron Belkin, helped launch a movement and was on the steps of the Supreme Court with the original bill leaders — Senator Ed Markey, Representative Hank Johnson, Representative Jerry Nadler, and former Representative Mondaire Jones for the introduction of the Judiciary Act in 2021.
The last time Congress changed the size of the Supreme Court it settled on 9 justices to match the number of judicial circuits. But while the number of circuit courts has increased over time to keep up with a growing population, the number of Supreme Court justices has remained static.
The Judiciary Act of 2023 would add 4 seats, taking the size of the court from 9 to 13 justices to match the number of circuit courts, while also rebalancing the Court following the Republican Court packing led by Trump and McConnell. The re-introduction of this historic piece of legislation under the leadership of Senator Markey and Representatives Johnson, Nadler, Schiff, and Bush is a critical step toward restoring balance to the Supreme Court.
