LIPTON-LUBET ON LATEST ALITO ETHICS SCANDAL: “DID THE WSJ RUN OUT OF SPACE ON ITS OPINION PAGE?”

SAN FRANCISCO, CA (June 26, 2023) — Today, new reporting in The Intercept revealed that Supreme Court Justice Sam Alito’s wife, Martha Bomgardner, leased land to a top U.S fossil fuel production company at the same time the Court considered a case threatening the authority of the Environmental Protection Agency.

“There are two big questions on my mind immediately after this latest Justice Alito ethics scandal,” said Sarah Lipton-Lubet, president of Take Back the Court Action Fund. “One: Did the the Wall Street Journal run out of space on their opinion page, or did Alito realize that prebutting each newsworthy scandal could quickly become a full-time job? And two: How many more ethics scandals will it take before Congress holds these justices accountable and calls them in to testify?”

Just last month in the Sackett v. EPA decision authored by Alito, the Supreme Court ruled that previously protected wetlands could be opened to pollution and destruction — threatening to increase flooding and droughts, and to hurt the health of families and communities across the country.
