LAWMAKERS, LAWYERS, AND ADVOCATES CALL ON CONGRESS TO INVESTIGATE JUSTICE ALITO

SAN FRANCISCO, CA (November 21) — This weekend, a bombshell New York Times report revealed that years before the leak of the draft opinion overturning Roe v. Wade this summer, Justice Samuel Alito allegedly leaked the outcome of Burwell v. Hobby Lobby — a case allowing businesses to refuse to cover birth control for their employees — to right-wing donors.

“The call is coming from inside the house at the Supreme Court, and obviously the justices can no longer be trusted to police themselves. Congress has to step up to its duty as a co-equal branch and conduct a swift, thorough investigation into whether one of the justices is systemically leaking sensitive information to right-wing political allies,” said Take Back the Court Action Fund Executive Director Sarah Lipton-Lubet on Saturday morning, shortly after the news broke.

The Times story also revealed a longer pattern of coordination between right-wing advocacy groups and the Republican-appointed justices, including Justice Alito. Take Back the Court previously called on Justice Alito and Justice Kavanaugh to recuse themselves from cases involving LGBTQ rights after they posed for photos at a secret meeting with leaders of the anti-LGBTQ hate group National Organization for Marriage.

Since the new allegations came to light, advocates, lawmakers, and lawyers alike have demanded that Congress investigate Justice Alito. The requests come as the Supreme Court continues its ongoing investigation into the Dobbs draft opinion leak. Senate Judiciary Committee Chair Dick Durbin announced on Saturday that the committee would review the Alito allegations, but these shocking revelations demand an immediate and full-fledged investigation.
